Simegen.com Terms of Residency

Simegen.com is owned by Sime~Gen(tm) Inc.

 

Establishing a website on simegen.com means that you agree to the Simegen.com Terms of Residency, as follows:

1.Simegen.com Personal Home Pages and E-mail accounts are available to persons 13 years of age or older, and persons under the age of 13 who have provided Sime~Gen Inc. with evidence of their parent’s or guardian’s express consent to obtain a website. Sime~Gen Inc. reserves the right to deny, suspend, or revoke any residency on simegen.com (without prior notice) in the event that Sime~Gen Inc. or simegen.com learns that a resident or person seeking residency is under the age of 13 and does not have his or her parent’s or guardian’s permission to be a resident of simegen.com.

2.Simegen.com Commercial Pages are available only to persons 18 years of age or older.

3.The opinions and views expressed in the Personal and Commercial Pages do not reflect those of Sime~Gen Inc. or simegen.com. The contents of the Personal and Commercial Pages, other than those owned by or copyright Sime~Gen Inc., are not reviewed in any way before they appear on simegen.com.  While we must protect our copyrights and trademarks in Sime~Gen content, Sime~Gen Inc. and simegen.com do not now claim and will never in the future claim any rights to any original work created and posted by residents of simegen.com.

4.Sime~Gen Inc. and simegen.com are not responsible for the content of any Personal or Commercial Pages except those expressly identified as the property of Sime~Gen Inc. Residents are solely responsible for everything contained in their own Personal or Commercial Pages. Sime~Gen Inc. and simegen.com do not verify, endorse or otherwise vouch for the contents of any Personal or Commercial Page other than those expressly identified as their own. Residents may be held legally liable for the contents of their Personal or Commercial Pages and may be held legally accountable if their pages include, for example, defamatory comments or material protected by copyright, trademark, patent or trade secret law without the express permission of the author or owner.

5.Sime~Gen Inc. and simegen.com are not responsible for the delivery of any goods or services sold or advertised through simegen.com sponsors or simegen.com residents' Commercial Pages.

6.Sime~Gen Inc. and simegen.com do not actively monitor the content of Personal or Commercial Pages, but will investigate complaints of a violation of the Simegen.com Content Guidelines and Terms of Residency. Please submit any such complaints to simegen@simegen.com or webmaster@simegen.com.

7.The resident agrees to indemnify and hold harmless Sime~Gen Inc. and simegen.com for any loss, liability, claim, damage, and expenses (including attorneys' fees) arising from or in connection with the contents of the resident's home page or use of the resident's simegen.com e-mail account.

8.Sime~Gen Inc. and simegen.com are not responsible or liable for any loss of data, nor are we required to return any data, resulting from our suspension or deletion of Personal or Commercial Pages, network or system outages, file corruption or any other reasons. We urge all residents to maintain backup versions of their pages to guard against losses of any kind.

 

Page Content Requirements

Sime~Gen Inc. and simegen.com do not permit either Personal or Commercial Pages on simegen.com which contain pornography, hate material, multi-level or pyramid marketing schemes, or any content prohibited by law. We also do not permit the use of server space assigned for Personal or Commercial Pages to be used for other purposes, including but not limited to storing personal or business files not linked to be viewed on simegen.com, storing downloadable material to be accessed via a site not on simegen.com, or storing images not linked to pages on simegen.com for the purpose of access from a commercial site such as Ebay to facilitate sales either by direct sale or auction. In no case will residents be permitted to avoid payment for commercial sites on simegen.com by storing income-producing materials on simegen.com to be accessed from another server for purposes of collecting that income.

In return for the services we offer, there are only three main requirements that we ask of our residents:

 1.  We ask that you support the Banner Advertising Program. These advertisements make your free pages possible and hold down the cost of your commercial pages.

 2.  We ask that you carry at the bottom of each of your pages the statement, "This page is hosted by simegen.com, a subsidiary of Sime~Gen Inc." and the Sime~Gen logo.

3.  We ask that you update your pages as frequently as possible to keep them fresh and new for repeat visitors, but in any event, we require that you update your pages at least once every twelve months.

Sales Pages on Non-Commercial (free) Sites Now Available

 

Commercial Sites

At this time, simegen.com is not prepared to offer full commercial websites, the sole or primary purpose of which is sales. We have an area of the domain set aside to develop such sites in the future, so please stay in contact if you are interested.

If you have more than six items for sale, but do not need a full commercial website, or if your site is primarily non-commercial but you need more than a single sales page, please contact webmaster@simegen.com   to discuss your individual needs.

 

Definition of Sales

Sales are anything for which you receive payment from visitors to your website: physical items you ship to customers, graphics or programs downloaded from your website, activities pursued on your website, information, memberships, etc. Anything for which you receive payment is a sale and requires you to have either a full commercial website if sales are your primary purpose, or a sales page on your non-commercial website otherwise.

 

Definition of Sales Page

A sales page is different from a non-commercial promotion page in that it provides all the information necessary for a visitor to place an order: product, price, shipping charges, method of payment, and means of purchase. It makes no difference whether a sales page is open to the general public or only to those who have passwords to reach it. Sales pages on simegen.com incur a low monthly charge.

 

Definition of Non-Commercial Promotion Page

Pages on non-commercial sites which promote the resident's creative endeavors without making anything available for sale are not to be construed as sales pages and will not incur charges. Examples of items on non-commercial site pages that are not construed as making them sales pages are samples of a writer's, artist's, or craftsperson's products provided free of charge; scans of an artist's or craftsperson's work or covers of a writer's books, without prices; book reviews; links to an author's own books on amazon.com, barnes&noble.com, or similar site where they may be purchased; programs which give the author a percentage of the sale price if the author's own work is purchased via a click-through from the author's site; or contact information such as e-mail address, postal address, or telephone number to allow interested parties to reach the writer, artist, or craftsperson for commission or purchase.

An example of a promotion page that is not defined as a sales page may be seen here. Contact information is provided, sample covers are shown, but no prices or shipping charges are provided, no order form appears on the page, and there is no way to order without obtaining further information via e-mail or postal mail.

 

Temporary Sales Pages

If you need a sales page for less than six months, please contact webmaster@simegen.com   to discuss your individual needs. A page which remains at the same URL but on which you change the items for sale from time to time is a permanent, not a temporary, page. An example of a temporary sales page might be the page of a local club within a nation-wide organization. That local club hosts the national meeting for one year--it moves somewhere else the next year. The club puts a temporary sales page on its site for six months to accept registrations for the meeting, payments for banquet tickets, t-shirts, etc. When the meeting is over, the club no longer needs the sales page, and the URL of that page is removed from the site.

 

Sales Pages on Non-Commercial Sites

Sime~Gen Inc. and simegen.com offer anyone with a non-commercial (free) site on simegen.com the opportunity to have a single sales page. This low-cost opportunity is intended for residents whose major purpose in building a website is something other than sales, but who have from one to six items for sale. This offer is not intended for individuals or companies whose sole or primary purpose in building a website is sales, even if they have six or fewer items for sale. Such individuals or companies should consider a commercial site.

 

Requirements of a Sales Page on a Non-Commercial Site

A sales page on a non-commercial site is a single page which advertises between one and six products with descriptions (may include graphics), prices, and ordering information. Upon visiting such a page, a customer may immediately place an order via an e-mail or postal mail address, a telephone or fax number, or a form supplied on the page.

If the products on a sales page on a non-commercial site are for sale to the public at large, we request that that page be placed in the /marketplace area of simegen.com, and linked from the resident's non-commercial site.

If the products on a sales page on a free site are for sale only to members of a particular organization, and may not be purchased by the public at large, then although it is still a sales page, it may remain on the resident's own site.

Putting up a non-commercial page on Simegen.com is an acknowledgement and

acceptance of the terms and conditions outlined above.

 

Intellectual Property Dispute Policy

In the event that Sime~Gen Inc. or simegen.com receives a complaint that the content of a Personal or Commercial Page allegedly infringes intellectual property rights or is otherwise unlawful, Sime~Gen Inc. may request written substantiation of the complaint from the complaining party, for example, substantiation of proof of ownership in the form of a trademark, service mark, patent or copyright. Sime~Gen Inc. will take the steps it believes to be appropriate under the circumstances, including, for example:

  1. Suspending the site, or a portion of the site, immediately until the dispute is resolved;
  2. Providing the resident with contact information for the complaining party;
  3. Instructing the resident to contact the complaining party to resolve the dispute;
  4. Informing the complaining party of our actions and asking that party to work directly with the resident;
    Note: All correspondence between the parties must also be sent to Sime~Gen Inc. (address provided);
  5. Taking the following action based on the progress of the dispute:
  • If the resident has not pursued resolution within 14 days of notification, the site, or portions of the site, will be deleted;
  • If the complaining party has not pursued resolution within 14 days of the resident's response, the site, or portions of the site, will be re-activated;
  • If legal action is pending or the dispute is not settled, the site, or portions of the site, may remain suspended until resolution is reached and Sime~Gen Inc. is notified by both parties as to the outcome;
  • If a resolution is reached between the parties, the site, or portions of the site, will be reactivated with any mutually agreed upon modifications.
  • If a copyright, trademark, patent, or other infringement is obvious (such as when pirated computer programs or information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs or any type of cracker utility, is being distributed), Sime~Gen Inc. and simegen.com also reserve the right, instead of following the above stated procedures, to delete all files and remove the resident without any warning.

 

Other Rights Reserved

Sime~Gen Inc. and simegen.com also reserve the following rights:

To amend or change the Simegen.com Content Guidelines or Terms of Residency at any time and without notice;

To release current or past resident information if Sime~Gen Inc. believes that a member's account is in violation of the Simegen.com Content Guidelines or Terms of Service, is being used to commit unlawful acts, if the information is subpoenaed, and/or if Sime~Gen Inc. or simegen.com deems it necessary and/or appropriate;

To deny membership to serious or repeat offenders of the Simegen.com Content Guidelines or Terms of Service;

To remove members for conduct that Sime~Gen Inc. or simegen.com believes is harmful to other residents, to non-residents, or to Sime~Gen Inc. or simegen.com as a business;

To remove members who interfere with the design and operation of the banner advertising, without warning;

To utilize third parties to provide services to simegen.com residents. These third parties may require limited access to residents’ personal identifying information in order to perform the services. Notice will be given to members at the time of collection or reasonable amount of time before sharing begins;

To use images of residents' pages for promotional and other commercial purposes.
